Terms of Service

Please read these Terms carefully before using BeaconFX.trade

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and BeaconFX ("we," "our," or "us"), the operator of BeaconFX.trade ("Platform"). By creating an account, purchasing a subscription, or accessing any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Platform. We reserve the right to update these Terms at any time. Material changes will be communicated via email or in-platform notification. Continued use after any update constitutes acceptance of the revised Terms.

2. Eligibility

To register and use the Platform, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts in your jurisdiction
  • Not be prohibited from accessing financial education services under any applicable law
  • Provide accurate, complete, and current registration information
  • Maintain the security and confidentiality of your account credentials
  • Not be a resident of any jurisdiction where access to this Platform is restricted or prohibited by law

We reserve the right to refuse registration or terminate accounts where eligibility requirements are not met.

3. Account Terms

3.1 Account Registration

You must register with a valid email address and create a secure password. You are responsible for all activity that occurs under your account. You must notify us immediately at support@beaconfx.trade if you suspect any unauthorised access to your account.

3.2 One Account Per User

Each individual may hold only one active account. Creating multiple accounts to circumvent access restrictions, subscription limits, or account suspensions is strictly prohibited and will result in termination of all associated accounts without refund.

3.3 Account Security Policy

For security purposes, each account is associated with a single authorised device at a time, subject to the fair usage limits defined in your subscription tier. Accessing your account from a new device may require re-authentication. Attempts to access the Platform from multiple devices simultaneously may trigger automatic session termination and may be flagged for review.

3.4 Account Sharing Prohibition

Subscriptions are for individual use only. Sharing your account credentials, login details, or access to any subscription feature with any other person is strictly prohibited. Violation of this policy will result in immediate account termination without refund and may result in legal action for breach of contract.

3.5 Accurate Information

You agree to keep your account information accurate and up to date. Providing false, misleading, or fraudulent information during registration or at any point during your use of the Platform is grounds for immediate termination.

4. Platform Services

BeaconFX provides a forex trading education and market intelligence platform. The services available to you depend on your subscription level and may include:

4.1 Market Intelligence

Access to our Market Intelligence system, which provides aggregated financial news, economic calendar data, currency strength indicators, and trade bias summaries. This content is updated automatically and is provided for informational and educational purposes only. It does not constitute financial advice.

4.2 Trading Education

Access to structured online courses, learning materials, and educational resources covering forex trading fundamentals, strategies, and market analysis. Course access is granted upon purchase and is subject to the access terms of your subscription tier.

4.3 Trading Signals

Access to trading signal content, including market analysis and trade setups. Signals are provided for educational and informational purposes only. They do not constitute personalised financial advice, and past signal performance does not guarantee future results. Any performance examples or results referenced on the Platform are illustrative only and do not represent guaranteed or typical outcomes. Trading results vary significantly between individual users.

4.4 Mentorship Programmes

Access to private and group mentorship sessions, subject to availability and your subscription tier. Mentorship sessions are educational in nature and do not constitute regulated financial advisory services.

4.5 Educational Resources

Access to downloadable e-books, guides, and reference materials. These resources are licensed for personal use only and may not be redistributed, resold, or shared.

4.6 Community Access

Access to our Telegram community channels and broadcast alerts, subject to your subscription tier. Community access is a supplementary feature and may be modified or discontinued at our discretion.

4.7 Broker Directory

Access to a curated directory of regulated broker partners. Broker listings are provided for informational purposes. We do not endorse any specific broker and are not responsible for the services, terms, or conduct of any listed broker.

We reserve the right to modify, suspend, or discontinue any feature or service at any time with reasonable notice where practicable. We do not guarantee uninterrupted or continuous access to the Platform and may experience downtime for maintenance, updates, or technical issues. We are not liable for any loss or inconvenience resulting from such interruptions.

5. Subscriptions & Payments

5.1 Subscription Tiers

BeaconFX offers multiple subscription tiers, each providing different levels of access to platform features. The features, pricing, and duration of each tier are as displayed on the Platform at the time of purchase. We reserve the right to adjust pricing and tier features with reasonable notice.

5.2 Payment Processing

Payments are processed securely through our authorised payment providers. We accept card payments and cryptocurrency. All transactions are processed in the currency displayed at checkout. We do not store your card details or cryptocurrency wallet information.

5.3 Subscription Duration & Renewal

Subscriptions are valid for the duration specified at the time of purchase. Subscriptions do not renew automatically. You are responsible for manually renewing your subscription before it expires to maintain uninterrupted access. We are not liable for any loss of access resulting from a lapsed subscription.

5.4 Course & Content Purchases

Individual course and content purchases grant you a non-transferable, non-exclusive licence to access the purchased content for personal educational use. Access is tied to your account and may not be transferred to another user.

5.5 Refund Policy

All purchases are subject to the following refund terms. Refunds are assessed in accordance with this policy and may be granted at our discretion in limited circumstances.

  • Refund requests submitted within 7 days of purchase will be reviewed on a case-by-case basis
  • No refunds will generally be issued after 7 days of subscription or content activation
  • Refunds may be declined where a violation of these Terms has occurred
  • Refunds may be declined for accounts terminated due to policy violations
  • Cryptocurrency payments may be irreversible depending on blockchain network conditions and are therefore generally not eligible for refund once processed
  • Approved refunds will be processed within 14 business days to the original payment method

To request a refund, contact support@beaconfx.trade with your order reference and reason for the request.

5.6 Chargebacks

Initiating a chargeback or payment dispute without first contacting us to resolve the issue is considered a breach of these Terms. We reserve the right to terminate your account and pursue recovery of any disputed amounts where a chargeback is found to be unwarranted.

6. Trading Risk Disclaimer

IMPORTANT — PLEASE READ CAREFULLY

BeaconFX is a trading education and market intelligence platform. We are not a licensed financial advisor, investment manager, or regulated broker. Nothing on this Platform constitutes personalised financial advice, a solicitation to trade, or a recommendation to buy or sell any financial instrument.

  • Trading forex, indices, commodities, and other financial instruments involves a substantial risk of loss and is not suitable for all investors
  • You may lose some or all of your invested capital. Do not trade with money you cannot afford to lose
  • Past performance of any signal, strategy, or educational content does not guarantee future results
  • Trading signals and market analysis are provided for informational and educational purposes only
  • You are solely responsible for all trading decisions, outcomes, and any financial losses incurred
  • Results vary significantly between individual traders based on experience, discipline, risk management, and market conditions
  • BeaconFX does not guarantee any specific trading outcome, profit, or return on investment
  • You should seek independent financial advice from a qualified professional before making any trading or investment decisions

By using this Platform, you acknowledge that you have read, understood, and accepted these risks in full.

7. Acceptable Use & Prohibited Conduct

By using the Platform, you agree to use it only for lawful purposes and in accordance with these Terms. The following conduct is strictly prohibited:

7.1 Content & Access Violations

  • Sharing, reselling, redistributing, or sublicensing any platform content, signals, courses, or materials to any third party
  • Recording, screenshotting, or reproducing any premium content for distribution outside the Platform
  • Accessing or attempting to access features or content beyond your authorised subscription level
  • Using another user's account or credentials to access the Platform

7.2 Technical Violations

  • Using automated tools, bots, scrapers, or scripts to access, extract, or interact with the Platform
  • Attempting to reverse engineer, decompile, disassemble, or modify any part of the Platform
  • Interfering with or disrupting the integrity, performance, or security of the Platform
  • Attempting to gain unauthorised access to any system, account, or data
  • Uploading or transmitting malicious code, viruses, or harmful content of any kind

7.3 Account & Identity Violations

  • Creating multiple accounts or using false identities to circumvent restrictions or suspensions
  • Providing false, misleading, or fraudulent information at any point
  • Impersonating BeaconFX, its staff, or any other user

7.4 Community & Conduct Violations

  • Harassing, threatening, abusing, or intimidating other users, community members, or BeaconFX staff
  • Posting spam, unsolicited promotions, or off-topic content in any community channel
  • Promoting competing services or soliciting other users within BeaconFX community spaces
  • Engaging in any conduct that is unlawful, defamatory, discriminatory, or harmful

Violation of any of the above will result in immediate account suspension or termination without refund. We reserve the right to pursue legal remedies where applicable.

8. Intellectual Property

All content, materials, and technology on the Platform are the exclusive property of BeaconFX or its licensors and are protected by applicable copyright, trademark, and intellectual property laws. This includes, without limitation:

  • Trading courses, video content, and educational materials
  • Trading signals, market analysis, and intelligence reports
  • E-books, guides, and downloadable resources
  • Platform design, software, and underlying code
  • The BeaconFX name, logo, and all associated branding and trademarks
  • Proprietary systems, data aggregation methods, and analytical tools

Your subscription or purchase grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the content for your own personal, non-commercial educational purposes only. No ownership rights are transferred. Any unauthorised use, reproduction, or distribution of our intellectual property is strictly prohibited and may result in legal action.

9. Broker Relationships & Affiliate Disclosure

BeaconFX maintains affiliate partnerships with regulated broker partners listed on the Platform. We may receive a commission when you register with or deposit funds through a broker via our referral links. This does not affect the price you pay or the services you receive from the broker.

Broker listings are provided for informational purposes only. BeaconFX does not act as an agent, representative, or guarantor of any listed broker. We are not responsible for the services, trading conditions, regulatory status, or conduct of any broker. You should conduct your own due diligence before opening an account with any broker.

Any dispute with a broker must be resolved directly with that broker under their own terms and conditions.

10. User-Submitted Content

Where the Platform allows you to submit content — including performance statistics, feedback, comments, or questions — you grant BeaconFX a non-exclusive, worldwide, royalty-free licence to use, display, and reproduce such content in connection with operating and improving the Platform.

You represent and warrant that any content you submit is accurate, does not infringe any third-party rights, and does not violate any applicable law. You remain solely responsible for any content you submit. We reserve the right to remove any user-submitted content at our discretion without notice.

11. Termination & Suspension

11.1 Termination by BeaconFX

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for reasons including but not limited to:

  • Violation of any provision of these Terms
  • Fraudulent, deceptive, or illegal activity
  • Account sharing or credential distribution
  • Initiating unwarranted chargebacks or payment disputes
  • Abusive or harmful conduct toward other users or staff
  • Any activity that poses a risk to the Platform, its users, or its integrity

11.2 Effect of Termination

Upon termination, your right to access the Platform and all associated content will be immediately revoked and all licences granted to you under these Terms will cease. We may terminate accounts without refund where there is a material breach of these Terms. The following provisions shall survive termination: Section 8 (Intellectual Property), Section 12 (Disclaimers), Section 13 (No Fiduciary Relationship), Section 14 (Limitation of Liability), Section 15 (Indemnification), Section 17 (Dispute Resolution), and Section 18 (Governing Law).

11.3 Termination by You

You may close your account at any time by contacting support@beaconfx.trade. Closing your account does not entitle you to a refund of any unused subscription period.

12. Disclaimers & Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, BeaconFX expressly disclaims all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Any warranty that the Platform will be uninterrupted, error-free, or free of harmful components
  • Any warranty regarding the accuracy, completeness, or timeliness of any market data, signals, or educational content
  • Any warranty that defects will be corrected or that the Platform is free of viruses or other harmful code

Market data, news, and intelligence content are aggregated from third-party sources. We do not warrant the accuracy or completeness of this data and accept no liability for decisions made based upon it.

13. No Fiduciary Relationship

Nothing in these Terms, and nothing arising from your use of the Platform, creates or shall be construed to create a fiduciary relationship, partnership, joint venture, agency, or employment relationship between you and BeaconFX. BeaconFX does not act as your financial advisor, investment manager, broker, or agent in any capacity. You are solely and exclusively responsible for your own financial decisions, trading activity, and outcomes.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • BeaconFX shall not be liable for any trading losses, financial damages, loss of profits, loss of data, or any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
  • BeaconFX shall not be liable for any losses arising from reliance on signals, market intelligence, educational content, or any other information provided on the Platform
  • BeaconFX shall not be liable for any service interruptions, data loss, or technical failures
  • BeaconFX shall not be liable for the acts, omissions, or services of any third-party broker, payment processor, or external service provider
  • Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount you paid to BeaconFX in the twelve (12) months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless BeaconFX and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of or access to the Platform
  • Your violation of any provision of these Terms
  • Your violation of any applicable law or regulation
  • Your infringement of any intellectual property or other rights of any third party
  • Any content you submit to the Platform
  • Any trading decisions you make based on content available on the Platform

16. Third-Party Services & Links

The Platform integrates with and links to third-party services including payment processors, broker websites, community platforms, and video streaming services. These third-party services are governed by their own terms and privacy policies. BeaconFX is not responsible for the content, availability, security, or practices of any third-party service.

Your use of any third-party service accessed through the Platform is at your own risk. We encourage you to review the terms and privacy policies of any third-party service before use.

17. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform, the parties agree to attempt resolution in the following order:

  1. Good faith negotiation — Contact us at legal@beaconfx.trade to attempt informal resolution. The parties shall negotiate in good faith for a period of no less than 30 days before escalating.
  2. Mediation — If negotiation fails, the parties agree to submit the dispute to a mutually agreed, independent mediator before proceeding to arbitration.
  3. Binding arbitration — If mediation fails, the dispute shall be finally resolved by binding arbitration conducted in Lagos, Nigeria, under the Arbitration and Conciliation Act (Cap A18, Laws of the Federation of Nigeria 2004), as amended. The arbitration shall be conducted in English by a sole arbitrator agreed upon by both parties, or appointed by the Lagos Court of Arbitration if no agreement is reached within 14 days. The arbitral award shall be final and binding on both parties.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against BeaconFX. Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction. Where mandatory consumer protection rights apply in your country of residence under applicable law, those rights are not affected by this clause. This arbitration agreement applies to the fullest extent permitted by applicable law.

18. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles. Subject to the dispute resolution process in Section 17, any legal proceedings that cannot be resolved through arbitration shall be subject to the exclusive jurisdiction of the courts of Nigeria.

If you access the Platform from outside Nigeria, you do so at your own initiative and are solely responsible for compliance with all applicable local laws and regulations in your jurisdiction, including any restrictions on accessing financial education or trading-related services.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email to your registered address and via an in-platform notification. The "Last Updated" date at the top of this page will reflect the most recent revision. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must discontinue use of the Platform and may request account deletion by contacting us.

20. General Provisions

20.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

20.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeaconFX with respect to your use of the Platform and supersede all prior agreements, representations, and understandings.

20.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of BeaconFX.

20.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Acknowledgment

BY ACCESSING OR USING BEACONFX.TRADE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND OUR PRIVACY POLICY. YOU ACKNOWLEDGE THE RISKS ASSOCIATED WITH TRADING FINANCIAL INSTRUMENTS AND ACCEPT FULL RESPONSIBILITY FOR YOUR TRADING DECISIONS AND THEIR OUTCOMES. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE PLATFORM.
